The Supreme Court Requires Differentiated Treatment of Cases

» China's Supreme Court, in an attempt to
strike a balance between efficiently settling legal cases and maintaining
corporate stability during the economic crisis, has introduced a new criterion
into the implementation of corporate court decisions on June 7.
» The
criterion distinguishes between two financial situations for enterprises: 1)
when an enterprise is temporarily deprived of the ability to pay its debts due
to the economic crisis and 2) when an enterprise intentionally circumvented or
rejected the implementation of the court's decisions.
» Concerned with
bankruptcy, unpaid salaries, and labor disputes brought about by the clearance
of company assets, the Supreme Court has required corporations to establish a
mechanism that would implement court decisions quickly.
